The Insurance Research Council (IRC) did a survey of 2,000 people and asked their opinion on attorney advertising. The council wanted to know how people feel about its impact, their awareness of the financing of litigation, attorneys and recent claim experiences, and why they did or did not choose legal representation.

The IRC noted attorney involvement often comes fairly quickly after a crash. The expectation of consumers on compensation, the complexity of a claim and the fairness of a settlement is often shaped by advertising.

Here are some conclusions:

• Attorney advertising is widespread

• 90% of respondents saw attorney ads in the last year

• TV is where most are seeing ads

• Those surveyed think attorney advertising causes claims and lawsuits to rise

• Over half believe advertising and attorney action is causing insurance rates to rise

• 25% have filed an auto injury claim in the last three years

• 70% consulted or hired an attorney and most often within days of a crash

• Injury severity, fair compensation and who is at fault are the main reasons to hire one

• The high cost of legal representation is the most commonly cited reason not to hire one
